OKLAHOMA CITY – Baby Veronica’s biological mother is suing the federal government over a law governing the placement of Native American children.
Christy Maldonado has filed a lawsuit against U.S. Attorney General Eric Holder, claiming parts of the Indian Child Welfare Act are unconstitutional.
Maldonado said the law uses race to determine who a child should live with and therefore violates equal protection provisions.
A South Carolina couple has been trying to adopt Veronica since she was born but a court ruling returned her to her biological father here in Oklahoma, Dusten Brown, because of his Cherokee heritage.
South Carolina’s highest court ruled last week that Veronica should be returned to her adoptive parents.
They recently denied Brown’s request for a re-hearing.
