Family sues after loved one mistakenly declared dead, freezes to death in morgue
LOS ANGELES – A family in Los Angeles has filed a lawsuit against a California hospital after it says its loved one was mistakenly declared dead, only to freeze to death in a morgue.
According to the Los Angeles Times, 80-year-old Maria de Jesus Arroyo suffered a heart attack in July 2010 and was pronounced dead.
When morticians received her body days later, Arroyo was allegedly face down with a broken nose and cuts and bruises to her face.
The family originally sued, saying Arroyo’s body had been mishandled.
During litigation, an expert says the woman suffered the injuries while she was still alive, indicating that she had been struggling.
The case was originally dismissed because a judge ruled it had been filed too late.
However, the appellate court found new information had been presented to the family, which changed the circumstances.
