Mother upset after 5-year-old son accused of sexual misconduct at school

SURPRISE, Ariz. (KTVK)- An Arizona mother is upset with her son’s school district after they told her that his actions in kindergarten will follow him throughout his educational career.

Last spring, 5-year-old Eric Lopez allegedly pulled his pants down on the playground at Ashton Ranch Elementary School.

According to KTVK, the child was forced to sign a note admitting to “sexual misconduct” and accepting a punishment before his mother was notified of the problem.

School officials say they are only required to call a parent if the student asks them to do so.

“He did not know that he could ask for me. He’s five,” said Erica Martinez, Eric’s mother.

Martinez says Eric has a note that will remain in his file for the duration of his time in the district.

For two months, she has fought to have the sexual misconduct label removed from the note.

So far, the district has denied that request.
