Elderly couple won’t pay restocking fee

SHAWNEE, Okla. - Vell Hall is 84 years old, and he is sticking to his guns.

“I don't feel I owe him a penny of that,” he said.

He said roofing company Superior Exterior keeps coming after him for a $900 restocking fee for materials they never even used on his roof.

“I thought I was signing an estimate,” Vell said. "That's true. I really thought I was signing an estimate.”

We've reported on similar complaints against Superior Exterior before.

More elderly customers allege the roofing company called them out of the blue, drew up what they thought was a free estimate then came after them for a restocking fee. 

“They have done nothing,” said customer Fred Price.

In all three cases, the seniors said the Superior salesman called up their insurance company without their permission, trying to open up a damage claim.

Vell's daughter is seriously worried about her parents.

“Just watching the stress and hearing the stress in mom's voice,” she said. “I know it is bothering daddy.”

She said she has a big problem with the agreement they had her dad sign.

For starters, the estimated cost of the job was left blank, and there doesn’t appear to be any mention of Superior’s roofing registration number, which could be a violation of state law.

“[My dad] didn't approach them. They approached him,” she said. “He told them straight up he didn't want to use them, but they still coerced him into signing it anyway.”

Back in 2010, we questioned owner Tamie Kiezel about the allegations, which she called baseless.

Five years later, we went to Kiezel with the new allegations.

She declined our invitation for a sit down interview but tells the In Your Corner team her company isn’t harassing anyone and customers knew exactly what they were agreeing to when they signed the dotted line.

And, about that insurance claim business, the owner said there is no way her salesmen would ever open up a customer's insurance claim without their permission.

“The bill is $1,000,” she said. “You could pay it, but he doesn't feel like he owes it and I don't feel like their contract is good.”

We have really good news to share.

Superior Exterior sent Vell a new invoice, this time with a zero balance, meaning he's off the hook for the restocking fee. 

Kiezel said that original invoice was sent to Vell and his wife by error.
