Appeals court: Third-party texters could be liable in accident

TRENTON, N.J. – Texters who send a message to someone behind the wheel of car in New Jersey could be held liable if that text is linked to an accident.

A New Jersey Court of Appeals issued an opinion that says third-party texters could be responsible in texting-related automobile accidents.

In order to be liable, the texter must know the person they are talking to is behind the wheel at the time the texts are sent.

Legal experts say it is the first time a court has said that someone could be liable for an accident while being electronically present.
