Former Oklahoma band teacher arrested for rape, indecent acts with a child

LUTHER, Okla. – A former Oklahoma band teacher was arrested for having a sexual relationship with a child under the age of 14, the Oklahoma State Bureau of Investigation announced Tuesday.

Kyle Whitmus, 33, was arrested for five counts of sexual misconduct involving a sexual relationship with a child under the age of 14, including rape in the first degree.

The Oklahoma County District Attorney officially charged Whitmus with seven counts of indecent of lewd acts with a child under 16, one count of first-degree rape and one count of soliciting sexual conduct with a minor.

Authorities say the charges stem from Whitmus’ contact with a preteen girl at Luther Middle School.

Whitmus was suspended from teaching once the allegations were reported to the school in April 2015, officials say.

The allegations came to light when a Luther Middle School student told her mother about the relationship.

That mother went to the victim’s father who, in turn, went to the Luther Police Department.

An investigator with Luther P.D. performed a preliminary investigation and then requested assistance from the OSBI.

Department of Homeland Security investigators forensically searched the victim’s cell phone for messages sent to and from Whitmus’ cell phone containing sexual content.

The former Luther band director was arrested at his Oklahoma City home early Tuesday morning.

Whitmus was booked into the Oklahoma County jail this morning on one count of rape in the first degree, three counts of indecent or lewd acts with a child under 16, and one count of solicit sexual conduct with a minor.

His bond is set at $200,000.
