Man convicted of killing man during road rage incident is shot, killed during fight in traffic

PLANT CITY, Fla. – A man who was just released from prison was shot and killed during a road rage incident on Wednesday.

Sheriff’s officials tell WFLA that Gary Lynn Durham was recently released from prison after spending 11 years behind bars for killing a man during a road rage incident.

In 2001, Durham followed 48-year-old Timothy Gibbs into a parking lot and punched him so hard he was brain-dead for days before dying from his injuries.

Durham was just released from prison, but found himself back in a similar situation.

On Wednesday morning, the Hillsborough County Sheriff’s Office says Durham stopped his truck in front of another driver, got out and walked to the man’s window.

At that point, an argument escalated and 42-year-old Robert Padgett warned Durham before pulling out a gun and shooting him.

Padgett performed CPR on Durham until paramedics arrived. However, Durham later died.

At this point, Padgett will not be arrested.
