Mother who was scheduled to testify against husband for killing 7-week-old found dead

SARASOTA, Fla. – A woman who was scheduled to testify against her husband for killing their 7-week-old baby boy was found dead in her jail cell over the weekend.

Kristen Bury and her husband, Joseph Walsh, were arrested last October after the couple’s seven-week-old son Chance was found buried in a shallow grave in the woods.

Deputies told WBBH that Walsh beat Chance and suffocated him by stuffing a baby wipe in the infant’s mouth.

Bury reportedly helped Walsh bury their son in the woods.

Earlier this year, Bury took a plea deal after she agreed to testify against Walsh.

She was sentenced to serve 25 years in prison for her role in her child murder, WBBH reports.

“Having the one person that was there with no other real significant evidence, other than some minor forensic evidence, and as well as no eye witnesses testimony — she was critical to the case,” Fort Myers criminal trial attorney Joe Viacava said.

Two months before she was scheduled to testify against Walsh, Bury was found dead in her jail cell.

Deputies believe she committed suicide.

The medical examiner will determine exact cause of death.

Attorneys now believe justice for Chance will be more difficult now that his mother has died, WBBH reports.

“This could turn into a dismissal of the case for all we know,” Viacava said.

“If she becomes the lynchpin to their case and she’s no longer there to testify, that could be the difference between a conviction and an acquittal,” Viacava continued.

Walsh’s murder trial is scheduled for November 14; however, that could change due to Bury’s death.
